Finally revealed the names of those responsible for the application of the Secret State environmental sull'ecatombe of Campania.
The shocking revelations of the boss Carmine Schiavone Disposal underground in vast areas of Campania of toxic and radioactive waste , and the recent spread of an investigation conducted by the U.S. Navy on the state of dangerousness of the land involved in these trades and the contamination of aquifers , of which I have been on this blog in my previous articles, can not help but make us reflect on the true perpetrators of this criminal environmental catastrophe . There are , in fact, far greater responsibility : the responsibility of the highest offices of state and institutions , knowing how things were, have been silent , hiding for years to the Italian people the truth , not initiating the necessary remediation and covering up all the eyes public opinion with the imposition of the Secret State .
In Italy , as well as being all cataloged , monitored and intercepted as in few other countries in the world , we are also victims of a systematic concealment of the truth on all major issues , with the indiscriminate application of the Secret State , an abominable practice that has also been applied to declarations of Carmine Schiavone, who , minuted in 1993 , were marked confidential by the first Prodi government in 1997 , remaining so for sixteen long years. It is in fact only this month that the secrecy has failed and we finally got to know the extent of this tragic story .
But what is the secret of state? It is a legal bond leading to the exclusion of a news item from disclosure by asking about sanctions against anyone who violates the constraint of silence. A practice that , despite heavily come into conflict with the fundamental civil rights guaranteed by the constitutions of all civilized countries (such as freedom of information , the right to safety, health and the protection of citizens ) , is applied with increasing frequency , thereby offending the dignity and intelligence of entire peoples .
The Secret State is also one of the few legitimate acts of competence of governments or parliaments that do not fulfill the requirements of its generality and universality of the laws , and that on the respect of individual people and events , which are typically areas of action of other subjects such as the judiciary and the press. May consist of prohibiting the publication of certain information , or to inspect documents, objects , places or people that lead to knowledge of confidential information. And it can be decided in advance, without being acts involving this type of risk , or following a formal request to proceed by the judiciary , or in the course of police investigations or investigative journalism .
This non-disclosure obligation is placed on a given story through a procedure that is equivalent to the fundamental principle of association and involving a finite number of information the disclosure of which could be limiting national sovereignty or security of civilian populations and resources.
The secret may relate to the facts of a military nature , civil or political . According to some critics the confidentiality of the documents shall affect the freedom of the press and the journalists' right to information of citizens, as well as the penalties for anyone who comes into possession of certain documents and publish them , can result in a form of censorship affecting the freedom of the press .
By contrast , its supporters argue that in some cases publish some information may cause damage on a scale much larger than the concealment itself, and that the state secret is a practice to be used sparingly , but sometimes necessary .
In Italy, the Criminal Code considers two levels of secret : secret in the true sense and disclosure prohibited .

Ministerial ( Ministerial Decree 1406/1995 n . 519 Defence and the DPC 1003/1999 n . 294 for the Secret Service ), and finally , by Law no. 124 of 3 August 2007 ( the "Information system for the security of the Republic and the new discipline of secrecy "), which , inspired by proposals for Giuseppe Cossiga , ridisciplinò radically the specific functions of individual employees , specifying their functional responsibilities . With this law were defined areas of competence of personnel , establishing areas where it is authorized to act instead , and areas where it is not, overcoming significant uncertainties that had been sources of controversy in the past. It introduced the Article 270 -bis of the Code of Criminal Procedure. For the purposes of this provision ( inserted in a hurry after the shameful story of the abduction of Abu Omar ) the court - when he has acquired, through wiretapping , communications service belonging to the Department for Safety Information or Services Information Security - shall immediately classified status and the housing in protected documents, supports and acts relating to such communications.
The law states that the Secret State should lapse after 15 years, which period may be extended by the President of the Council ( or other competent authorities ), but can never exceed 30 years. We know , however, that there are cases , such as that of the Ustica disaster , on which the secret persists to the bitter end , then in defiance not only to the same laws of that State , but also the thirst for truth and justice of the relatives of the victims.
A further crackdown on the suppression and concealment of the truths was given April 16, 2008 , with the publication in the Official Gazette of the Decree of the President of the Council of Ministers on April 8 , which defines the " supreme interests to be defended with the Secret State ":" integrity of the Republic, also in relation to international agreements , and the defense of the institutions established by the Constitution as its foundation , the independence of the state compared to other states , and relations with them, the preparation and military defense of the State . "
The Constitutional Court, in a judgment of 11 March 2009 ( No. 106) , has expressed excluding the judicial review on the identification of news that would constitute a state secret , pronounces what has been called "scandalous " by many constitutionalists .
According to the Court , " the identification of the acts, facts, information that may compromise the security of the State and which must remain secret " is the result of an assessment " largely discretionary ." Are ruled out any judicial review, because "it is inhibited to the jurisdiction of the place of the executive power and public administration , and to work on the union of their acts." The exercise of power would then be subject to a confidentiality Parliament alone , " normal seat control on the merits of the highest and most serious decisions of the executive " , through the Parliamentary Committee for the Security of the Republic ( Copasir already Copaco ) .
With the same pronunciation , the Constitutional Court has extended to the agents investigated the provisions of art . 41 of Law 124/2007 , namely that " public officials , government employees and the public servants are forbidden to report on the facts covered by state secrecy " , allowing it to Marco Mancini to avoid the judgment with reference to the scandal " SISMI - Telecom " .
From Ustica up to chemtrails , through the vicissitudes dell'Italicus , Abu Omar and Niccolo Pollari , it is not easy to find a complete and exhaustive list of all the cases in which the Secret State has been imposed in recent decades by various governments that have taken place , but I must point out that Silvio Berlusconi has broken all records , intensifying as never before the use of this shameful practice, coming to the imposition of the Secret State even on the work of his private villa in Sardinia (Villa Certosa) .
The extensive use of the Secret State especially during the fourth Berlusconi government has raised numerous criticisms , including those of Felice Casson , according to which " it has been customary use exaggerated and incorrect affixing of the Secret State " , and would forget " the constitutionally protected interests at stake : the ascertainment of the truth about serious facts and the exercise of jurisdiction ." "The message that goes - according to Casson - is that the Secret Service can do what they want, so then they can appeal to secrecy and it all ends there ."
I wanted to make a little ' history , to be sure , however, not to have bored, now to be able to better focus on the issue of toxic waste bell and to understand how it was possible that the statements made by Carmine Schiavone during the hearing the Commission parliamentary inquiry into the cycle of waste and illegal activities related to it have been marked confidential , and therefore deliberately kept hidden to the public , for 16 years .
Who, and especially because , were the perpetrators of this criminal concealment of the truth that has cost the lives , in all this time , thousands of unsuspecting citizens of cancer deaths for having continued to reside in contaminated areas , and for continuing to feed on fruits of those tormented lands ?
Giampaolo Rossi, in his courageous article just published on the blog of independent information Wilditaly , made first and last names , identifying the main responsible for the secretamento of this very serious matter. People who were at the top of the institutions and, above all , in key roles that involved judicial matters from that period and, inevitably, also the statements of Schiavone . Characters who knew , or that " they could not know " and that they deliberately took the decision not to speak, to hide the public of what is perhaps the worst environmental disaster in the history of Italian and silencing information that was essential to protect the health of people living in areas contaminated by deadly toxic and radioactive waste .
Well, the hearing of Carmine Schiavone was on 7 October 1997. The President of the Parliamentary Commission of Inquiry was Massimo Scalia , then Deputy of the Mixed Group . The members of the Commission were present at the hearing of the boss Gianfranco Saraca (Forza Italy ), Giovanni Di Rich Lubrano ( Green - Olive) , Roberto Napoliu ( Christian Democrats ) and Giuseppe Mirror ( National Alliance ) .
President of the Republic was at that time Oscar Luigi Scalfaro . Prime Minister Romano Prodi and was Secretary of the Council of Ministers was Luigi Enrico Micheli. At the Ministry of the Interior sat Giorgio Napolitano (in office from 17 May 1996 to 21 October 1998) , while Giovanni Maria Flick occupied the Ministry of Justice . Edward Ronchi was the Minister of the Environment , and Chairman of the Constitutional Court was in those days Renato Granata . Vice Chairman of the Board was Walter Veltroni , and the Presidency of the House and Senate respectively sat Luciano Violante and Nicola Mancino.
No doubt about it : a really good company! These are , as noted by Giampaolo Rossi , the names of the characters who have decided , favorite (or not preventing ) the imposition of the Secret State .
Rossi was not able to identify with certainty who was at that time the Director of COPACO the Committee that preceded the COPAS , born in 2007, but he shows us , however, who was at that time the Secretary General of CESIS ( Executive Committee for Intelligence and Security Services ) : Francesco Berardino .
Most of these characters still play leading roles in Italian politics and institutions of the Republic.
In a "normal" country would have at least had the dignity to resign, before ending perhaps in the process . In countries such as China could hardly have avoided the firing squad.
In Italy , where anything is allowed , provided that happen in the face of the people , silence reigns supreme . But it is a deafening silence , dead silence , as the fumes emanating from the ground in areas contaminated by the Casalesi .
